OVERVIEW 

This website is operated by The Tack Shop. Throughout the site, the terms “we”, “us” and “our” refer to The Tack Shop. The Tack Shop offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers or merchants.

Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse or cancel orders placed for products listed at the incorrect price. 

We cannot guarantee the availability of any products listed on our site. We reserve the right to revise or cease any product/s, without prior notice.

We will not be held responsible for product/s lost or damaged in transit. 

Any claims, such as incorrect size received, must be made within seven days of delivery. 

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

 

SECTION 2 - REFUNDS AND RETURNS

We do not offer refunds on items unless they are deemed to have a manufacture fault.

Change of mind purchases will be issued with a store credit to the value of the returned product. Store credits may be used in store or online and have no expiry.  

Sale items and Special Orders are non-returnable, with the exception of manufacture faults. 

Gift Vouchers are non-refundable.

SECTION 3 - PRE-ORDER AND SPECIAL ORDER TERMS

A Pre-Order refers to an item that is incoming, but not currently in stock. A Special or Custom Order refers to an item that we do not carry stock of and it will be ordered in specially as per the customers requirements. 

We cannot always guarantee the availability or delivery dates of pre-orders and special orders. Orders cannot be altered or cancelled once your order has been confirmed, unless it is unable to be delivered within a reasonable timeframe.

Estimated arrival times for pre-orders and special orders are only estimates and may vary due to delays out of our control. 

If you purchase an ‘In stock’ item with ‘Pre-Order’ or ‘Special Order’ item, please take into account that any in stock items, will not be dispatched until all items are in stock and available for dispatch, unless you choose to pay additional postage.

In the event that an item you have Pre-Ordered or Special Ordered is in fact unavailable at the time (e.g. out of stock with our supplier), we will contact you and advise an ETA. If you do not find the ETA acceptable, you will be offered the option of an exchange or refund. 

 

SECTION 4 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service.

 

SECTION 5 - PAYMENT AND PRICING

We accept payment via Credit Card, PayPal, Afterpay and zipPay. No goods will be dispatched until full payment has been received. 

All of our prices are in $AUD and are GST inclusive.

Prices may vary and we reserve the right to make changes to our prices at any given time without prior notification.

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 7 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

 

SECTION 8 - DELIVERY TERMS

Orders place before 2pm ACDT Tuesday to Friday will be dispatched same business day, subject to stock availability. Orders placed weekends and public holidays will be dispatched next business day.

We can deliver to your Home or Business Address. Please consider where you will be at the estimated time of delivery and ensure you enter the relevant delivery address.

If you are not home to receive your order, the delivery drive may choose to leave your order at your address unless you have selected 'Signature on Delivery'. If you are not able to be home to accept your order, you accept liability of your purchased item/s being left at your delivery address and we cannot be held responsible if your order were to be stolen from your door. If you do not want your order to be left at your delivery address, please ensure you select 'Signature on Delivery'.

 

SECTION 9 - CANCELLATION OF ORDERS

If your order was not a special order or purchased on sale and has not yet been shipped, you may be able to cancel or make a change.

Cancellation of orders due to buyer default will be less a restocking fee of 10% to cover merchant and admin fees. 

To make changes to your order, or if you wish to cancel you order, please email sales@thetackshop.com.au - please include your order number, along with the reason for the changes or cancellation.

If you order has already been shipped, you will need to refer to our Returns Policy.

Special orders cannot be changed or cancelled once placed.
